Hi,
I have applied my I-485 (EB3, PD - 2004 Feb) last week. Planning to file EB2 PERM with the same employer next week for porting the EB3 dates. My doubts are
1) Can we file an interim application at I-485 stage for porting the EB3 priority date for EB2, rather than filing a second I-485?
2) After the EB2 I-140 approval, do we need to wait for my priority dates to become current for submitting the interim application for EB2 I-485?
3) I am doing this for getting the GC comparitively earlier. But is there any issues/threats for doing like this?
Gurus, please comment the pros and cons of this.

My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?
We took our 17 month old daughter with us. You should not have a problem with that.
BTW, The only problem we had was that our daughter was scared of the tough looking security guy and she started crying as soon as she saw him and we had a hard time consoling her :)

I heard that PD is still ours even in the case of abandonment of 485. So, I still hope that some day we can come back to US to re-do the green card application. My question is, once PD becomes current, how long will the window to submit 485 be open for us?

In order to preserve the PD, you will require a copy of your approved 140. Do you have the copy - in that case, next time you will have to file labor and at 140 stage, you can get your PD back.

Don't worry..Apply for EAD replacement Card immediately...You can work for 90 days based on EAD replacement Receipt Notice.

I lost my renewed EAD. It was approved for 2 years. My license is expiring in SEP 30th. Can I submit AP in DMV for status check. If I applying EAD for lost card, Can I at least submit receipt notice? I dont think I wont get replaced card before SEP 30. Please help me. I am not in H1B status.

Hi,
I got 2 year EAD from NSC in August 2008.
Wanted to apply for Advance Parole (second time).
Is NSC issuing 2 year AP's ?
Wondering if any body got Advance Parole for 2 years from NSC.
Also, I appreciate if any one can share their experince about INFOPASS to get Advance Parole in case of emergency
(if one did not apply for AP & need to travel urgently).

As you know if you can find another job based on H1 then no problem in porting your H1 to a new employer,now being in feb april is 50 days away so hope for best.
In this situation, yes, legal advice is preferred, relying info on the forums is never a right idea when it comes to a situation where stakes are high.
If there is any option of changing to H4 now and switching back to H1 later and pick the GC process where it was left before then that would be an ideal scenario, only an experienced attorney can answer this, hence the legal advice option.
Compared to H4, over stay may cause more trouble for now and later in AOS.
PS: My 2 cents and i'm not an attorney.

1. You can definitely change the employer and invoke AC21. No issues there..
2. You can change AOS to consular, but not after you've invoked AC21.
Actually there's probably a way to do that too , but maybe a good (and probably expensive) lawyer needs to be consulted.

this is just like what people talk about IRS. I got packet in mail asking to contact immediatly field officer at local office regarding 2006 tax returns. Thinking worst, I didn't even go beyond subject line and everybody I talked or told, scared me to death. Finally, I mustered up courage to go line-by-line. Didn't understand what they were talking about and neither did the notice had my name or SSN. So left with no-choice, called IRS and found that documents were for previous resident!
Lession for me (and all) ... if you haven't done anything wrong intentially, their is nothing to be afraid about.
